PORT TOWNSEND — A 28-year-old Port Orchard man has been sentenced to 41 months in jail for his role in several assaults almost one year ago.
Jefferson County Superior Court Judge Craddock Verser imposed the sentence on Kaleb Mayo, 28, on Friday after studying the sentencing guidelines and determining that a 10-year sentence requested by prosecutors did not fall within those guidelines.
Jury deliberations
On Oct. 18, Mayo was found guilty of one count of aggravated assault in the second degree and two counts of assault in the fourth degree after a seven-day trial and two hours of jury deliberation.
Mayo had severely beaten Lenard Marion in December 2011 and left him bloodied and seriously injured along the side of a road in Port Townsend, then eluded law enforcement for months.
He also assaulted two others.
After the conviction, Verser granted a continuance of sentencing at the request of Mayo’s attorney, Adrian Pimentel, to re-evaluate the sentencing boundaries.
Pimentel, who was appointed by the court to represent Mayo, sought to eliminate the aggravator clause in the verdict, which would decrease the sentencing range from about 10 years to 23 to 29 months, saying it didn’t apply in this case.
During the trial, Deputy Prosecuting Attorney Chris Ashcraft had requested a 10-year sentence, citing the severity of the crime.
Transfer to Shelton
The terms of the sentence require Mayo to spend one year in the Jefferson County jail before his transfer to the state penitentiary in Shelton, Ashcraft said.
Mayo has been in jail since April 11 and will receive credit for time served; with good behavior, he could be released in the next 18 months, Ashcraft said.
