The Critical Areas Ordinance lawsuit survived its first challenge Friday as a judge denied a motion to dismiss the matter.
Pro Tempore Judge William Knebes decided the lawsuit meets the proper legal criteria to proceed in Clallam County Superior Court.
“The court definitely has subject matter jurisdiction on this,” Knebes said. “This is a proper matter before the court. The motion to dismiss is denied.”
Property-rights activist Bob Forde of Sequim had filed the motion to dismiss the Critical Areas Ordinance lawsuit, which names him as a defendant.
