PORT ANGELES – The wrongful-dismissal appeal of a teacher who was fired for insubordination in the Port Angeles School District will be heard by a federal judge.
Linda Capo, a 62-year-old special-education teacher, was fired for ignoring Port Angeles School District orders to stay away from the boy she was home-tutoring following a school district investigation of her relationship with the boy.
An appeal of the firing was heard in Port Angeles in October by retired state Supreme Court Justice Faith Ireland.
Ireland upheld the dismissal.
Capo was fired for ignoring a district order to stay away from the boy during the investigation.
The boy is not named in this report because he is a minor.
Capo took an interest in the boy while researching a book, and began to tutor the troubled 15-year-old – even staying overnight in the home where the boy lived.
The school district sought two other charges – that Capo engaged in an inappropriate relationship, called “boundary invasion,” with the student and that she exercised poor professional judgment – but Ireland dismissed those charges.
