FORKS — Charges by people seeking to recall Mayor Nedra Reed range from unsubstantiated to frivolous to bogus, Reed’s attorney said Thursday.
Craig A. Ritchie’s filed a 24-page memorandum opposing the recall petition in Clallam County Superior Court.
The petition itself is invalid, Ritchie said, because the seven petitioners failed to swear they have personal knowledge of the facts they assert.
The petition also lacks evidence and legal sufficiency, attacks actions that were valid discretionary acts, challenges deeds that were Reed’s right to perform as mayor, and fails to spell out for voters what merits Reed’s ouster from office, he said.
Judge Ken Williams is expected on Thursday to schedule hearings on the charges and their wording.
He won’t rule on the truth of the charges.
Instead, the judge is to look at the facts surrounding the case, as well as whether the charges have legal sufficiency to recall an elected official.
