Port Ludlow Associates reaches settlement regarding Olympic Terrace II

PORT LUDLOW — After a month of negotiations with developer Port Ludlow Associates, appellants against the Olympic Terrace II development have agreed to refrain from further legal appeals.

Port Ludlow residents Leslie Powers and Rick Rozzell appealed an Oct. 5, 2005, Jefferson County hearing examiner’s decision that said the proposed Olympic Terrace II was in compliance with state and county statutes.

Olympic Terrace II is an 80-lot single-family detached subdivision on 160 acres owned by Port Ludlow Associates.

Powers and Rozzell’s attorney, Yakima-based James Perkins, argued that Port Ludlow Associates was improperly “piecemealing” its 1,200-acre Master Plan Resort.

They said that Port Ludlow Associates was trying to build Olympic Terrace II without also constructing resort amenities that Perkins claimed the developer was obligated to concurrently build.

In March, the Powers’ and Rozzell’s appeal was dismissed by a visiting Kitsap County Superior Court judge.

The interim settlement agreement was signed April 20 by Powers and Rozzell, in which they agreed not to file any more appeals.
