PORT TOWNSEND — Both Defense Attorney Alton McFadden and Prosecuting Attorney Juelie Dalzell agree that Dalzell has to prove a key piece of evidence in the trial of former Chimacum High School Principal Rex Whipple.
Whipple is charged with one count of sexual exploitation of a minor and 10 counts of possessing depictions of a minor in sexually explicit conduct.
The trial continues at 9 a.m. today in Jefferson County Superior Court, 1820 Jefferson St.
“What essentially she needs to prove is that Mr. Whipple took some affirmative act to get [the girl] to disrobe,” McFadden said Tuesday once the trial had recessed for the day.
Dalzell agreed, and added, “I think we have presented evidence that proves the elements.”
Dalzell attempted to amend her charges to include 11 counts of voyeurism both Monday and Tuesday.
Judge Craddock Verser, who is the sole decider of the case because the defense waived the right to a trial by jury, denied both attempts.
