PORT ORCHARD — A Kitsap County Superior Court judge has denied Security Services Northwest’s motion for a stay of a county hearing examiner’s decision that threatens the company’s future.
In his decision, which came after Security Services and county attorney’s argued their cases March 10 in the Kitsap court, Judge Jay B. Roof states that Security Services “failed to prove sufficient grounds and factual basis for this request.”
Security Services’ attorney Glenn Amster had argued that a stay was needed to given the Gardiner-based company relief from county Hearing Examiner Irv Berteig’s decision while the company appealed that decision in Kitsap County.
Berteig’s decision basically backed the county’s stop-work orders, concluding that the company was without appropriate development permits, not a non-conforming land use and was not legally operating in the county.
“We have to accept the ruling and we will,” John Devlin III, Seattle co-counsel with Amster for Security Services president Joe D’Amico.
“We will continue with the appeal of hearing examiner’s decision,” said Devlin.
“What this decision means is SSNW just continue on as it has been, not violating the [county] stop-work orders.”
“It just won’t conduct weapons training on the property, or do anything in the various buildings used for training. SSNW has not and will not violate the stop-work order.”
