Citizens group Sequim First was dealt another blow by Thurston County Superior Court Judge Thomas McPhee in its attempt to stall construction of a Wal-Mart “supercenter” in Sequim.
McPhee on Wednesday in Olympia refused to reconsider his March 19 ruling which denied an appeal filed by Sequim First challenging the City Council’s initial permitting for a 195,000-square-foot Wal-Mart at West Washington Street and Priest Road.
The appeal sought an independent environmental-impact statement prior to any permitting for the project.
Sequim First has until June 4 to decide whether it will appeal McPhee’s decision before the state Court of Appeals.
The group faces a similar appeal deadline — this one on Monday — over a larger shopping center complex to be anchored by The Home Depot across Washington Street from Wal-Mart.
Sequim First Vice President Andrew Shogren said he was disappointed with McPhee’s ruling — especially since a similar appeal filed against the other shopping center received greater scrutiny by a Clallam County judge.
